The domain names are governed by ICANN (Internet Corporation for Assigned Names and Numbers), which has been established a modicum of legitimacy. The Uniform Dispute Resolution process (UDRP) developed for managing the domain names disputes has made domain name dispute resolution much cheaper and faster than before.
 
National Arbitration Center for International Arbitration and Alternate Dispute Resolution is a private institutional arbitral organization based at New Delhi, India. We have applied to ICANN for approval as a Domain Name Dispute Resolution Service Provider. The application is pending at ICANN, and once approved, we shall be able to administer domain name disputes in the Indian sub-continent.

The number of registrations of top level domain names in India are ever increasing and according to the latest statistics, India was one of the largest registrar of domain names. Another fact is that in India, a large number of individuals and business houses suffer because of squatters, who infringe the intellectual property rights of the rightful owner. However, very few of them seek redressal from ICANN approved dispute resolution providers. The main reason behind this is that most of the individuals and companies cannot afford to pay the high arbitration fees. And even in cases where they can afford, the lengthy and tedious foreign exchange procedures discourage them from approaching these providers.
 
In case of disputes, the domain owners generally approach the Court of Law, which is already overburdened with millions of pending cases. It is said that if we keep going at the same pace, it will take 20 years to deal with the cases pending till date. It takes nearly a decade to settle a case, and by that time the actual purpose for filing the case is lost. The Indian government is encouraging Arbitration Centers, such as ours because it will serve a public cause too. If given a chance, we can provide very competitive and affordable fee structure for India and other developing countries. We will be able to do because the clerical management is very cheap in India as compared to any western countries.
 
We already have on our Panel, Arbitrators from different Countries who are experts in the Domain Name Disputes and are on the panel of one or more ICANN approved service providers. Also, we being already in the dot com business, very well understand the need for a fast, reliable and technologically advanced service provider for handling such domain name disputes.
 
We have developed standards, procedure, and software required to provide quality services on the basis of the ICANN rules and policies. All these procedures are have been developed keeping in mind the total quality movement and the ISO standards.  Two points have been kept in mind while formulating process and procedures, which are:
 
  • Careful design of the entire Uniform Dispute Resolution Process keeping in mind the administrative compliance within the organization, technical expertise of the arbitrators and the administrators, the entire clerical process, and documentation as per the guidelines of UNCITRAL, ICANN and ISO.
  • Ensuring that the Center's systems can consistently produce and follow the same in totality.
Another major success of National Arbitration Center is that Mr. Arif Hyder Ali has consented to join the Advisory Board of National Arbitration Center. Mr Arif Ali has worked as a Senior Counsel at World Intellectual Property Organization and was a key person in developing the Uniform Dispute Resolution Policy, followed by ICANN. Mr. Ali will be personally supervising the entire administrative process for domain name dispute resolution.
